Welshot Imaging Terms and Conditions (updated 12th of June 2010)
- Welshot Imaging Ltd requires a deposit against the workshop costs for
all Residential and Overseas Experiences as stated in each Workshop description
at the time of booking. A completed booking form must be sent to Welshot
Imaging Ltd. Payment in full is required 70 days before departure for any
Welshot Imaging Residential and Overseas Experience Workshops.
- Welshot Imaging Ltd requires that any cancellation by the client must
be made in writing, emails are acceptable, however, we strongly advise that
you request a “Delivered” and/or “Read” receipt. This will be acknowledged
by Welshot to confirm receipt of your cancellation. The date on the letter
/ email received by us will determine the cancellation charges applicable.
Cancellations made before 56 days will receive a 90% refund on the cost of
the Welshot Workshop only. No refund will be given within 56 days of departure
date.
One day Workshops are payable in full at time of booking and
a completed booking form must be sent to Welshot Imaging Ltd. Cancellations
up to 8 days before the workshop date will be eligible for a 90% refund or
transfer to another workshop. Cancellations 7 days or less will receive no
refund and unable to transfer.
- Welshot Imaging Ltd maintains that the receipt of a payment does not
imply acceptance of a booking. Welshot Imaging Ltd will confirm acceptance
of a booking in writing, and it is at the time we send out this confirmation
that a contract comes into existence between us. An administration charge
of £5 may be made for alterations or amendments to a booking. The intention
to transfer should be notified in writing, emails are acceptable, however,
we strongly advise you to request a “Delivered” and/or “Read” request.
- Welshot Imaging Ltd reserves the right to alter or cancel any workshop.
Should an alteration or cancellation become necessary, except where the cancellation
is due to under-booking or force majeure as defined in clause 5, you will
then have the choice of accepting the alteration, taking an alternative workshop
(and where this is of a lower price we will refund the difference), or withdrawing
from the contract and accepting a refund of all monies paid to Welshot Imaging
Ltd. For the avoidance of doubt, as Welshot Imaging Ltd is not party to any
flight bookings made by clients and has received no payment for the same,
we will not refund the costs of flights or other travel costs in the event
of UK or non-UK Workshop cancellation. You are referred to clause 17 below.
- Welshot Imaging Ltd reserves the right to require a minimum number of
fee-paying participants to each workshop. Under-booking is the situation
in which the minimum number of bookings required to run a workshop is not
met, and if Welshot Imaging Ltd have to cancel a workshop for this reason,
we will not do so less than 7 days prior to the date of the Workshop. Force
majeure refers to unusual and unforeseeable circumstances beyond our control,
such as war or the threat of war, riots, terrorist activity, civil strife,
industrial disputes, natural or nuclear disaster, fire, flood or adverse
weather conditions.
- Only the person(s) booked may attend the Workshop. If a client has special
needs that require a helper then please contact us beforehand to arrange
this. Non-participating guests are not allowed to attend without prior consent.
- Data provided by clients when booking will be held centrally by Welshot
Imaging Ltd.
- In the event of the specified tutor being unable to attend due to illness
or other circumstances beyond our control, another workshop leader will be
provided. If this is not possible, then the Workshop will be cancelled and
the provisions of clause 4 will come into effect.
- Welshot Imaging Ltd reserve the right to change any of the prices, service
or other particulars contained in this document at any time before we enter
into contract with you. If there is any change, we will notify you before
we enter into such contract.
- Unless otherwise stated in the Workshop particulars refreshments and
meals are not included in the fee. Admission to any venues or attractions
is not included unless stated. Welshot Imaging Ltd reminds clients that if
they have special dietary or other requests, they should inform us of these
at the time of booking. We will advise the relevant supplier of your requirements,
but we cannot guarantee that such requests will be met, and will have no
liability to you if such requests are not met.
- All Welshot Imaging Ltd clients that children under 16 must be accompanied
by an adult throughout the Workshop and/or Academy Evenings.
- It is understood that during your tuition with Welshot Imaging Ltd, you
may visit a variety of outdoor and indoor locations. Welshot Imaging Ltd
will undertake appropriate risk assessments and implement such safety procedures
as required by law. However, clients are reminded that during the duration
of the Workshop, when they are visiting, preparing for or travelling to or
from these locations, they are required to comply fully with the instructions
and procedures established by Welshot Imaging Ltd and thereby accept their
responsibility for their own safety and that of fellow participants.
- Welshot Imaging Ltd reserve the right to refuse admittance or demand
the withdrawal of a client from a Workshop and /or Academy Evening where
their behaviour is deemed to be inappropriate, unacceptable, unsafe or disruptive
or in any way to damage the conduct of a Workshop or other Photographic event.
- Welshot Imaging Ltd does not accept liability for any injury, expense,
loss or other damage caused to clients by the acts or omissions of others.
- With non-UK workshops, participants arriving or departing on different
flights will be responsible for their own transfer costs and arrangements.
Flight booking is the client’s responsibility and Welshot Imaging Ltd is
not responsible for any expenses, loss or other damage caused to you by the
acts or omissions of the carrier. You are referred to clause 18 below.
- The type of Workshops that Welshot Imaging Ltd offers requires flexibility
and must allow for the provision of alternatives. For this reason the outline
itinerary and holiday description must be taken as an indication of what
may take place on the workshop, and not as a contractual obligation on the
part of the company.
- Welshot Imaging Ltd does not accept liability for any loss or additional
expense caused by delay or interruption to travel services through weather
conditions, civil disturbance, industrial action, strikes, wars, floods or
sickness. Such losses or additional expenses are the responsibility of the
passenger.
- Welshot Imaging Ltd accepts responsibility for acts and/or omissions
of its employees (whilst acting in the course of their employment). The Company
does not accept responsibility or liability for death, bodily injury, illness
or loss caused to the client or any other person included on the booking
form, unless arising from the negligent act and/or omission of the Company’s
employees (whilst acting in the course of their employment). Any claims shall
be subject to English law in respect of any question of liability or quantum,
and all proceedings shall be within the exclusive domain of the English courts.
- The client must communicate any perceived failure in the performance
of this contract on the spot to the Workshop Leader thus giving the Workshop
Leader the opportunity to achieve a satisfactory solution. Should this not
be possible, you should make your complaint known to us in writing within
28 days of the completion of the workshop.
- Welshot Imaging Ltd asserts that it is a term of the contract between
us that each client will obtain the appropriate insurance cover before embarking
upon the Workshop (whether UK or non-UK). During our Workshops your equipment
may be subject to the elements or accidental damage. Welshot Imaging Ltd
is not responsible for any damage incurred to your photographic equipment
or belongings whilst participating on one of our Workshops. The insurance
arranged by each client must cover the loss, expenses and damages arising
from, including but not limited to, the cancellation of the Workshop (whether
in whole or in part), personal accident and injury, medical and repatriation
costs (for overseas workshops), loss of baggage and personal money and belongings
and flight cancellations and delays.
- For all non-UK workshops, all clients must be in possession of a valid
passport and all visas, permits and certificates, including medical certificates
required for the whole of the journey and the client accepts responsibility
for obtaining the same. All information and advice given by us on visas,
vaccinations, climate, clothing, baggage, special equipment etc. is given
in good faith but must not be relied upon by clients in planning their travel
arrangements. Clients are advised to confirm arrangements that currently
apply with the appropriate authorities.
- In the unlikely event that Welshot Imaging Ltd become unable to provide
a significant proportion of the services you have booked after you depart,
we will make alternative arrangements for you at no extra charge, or if this
is impossible, we will provide you with transport back to the point of departure
from your workshop destination, and a pro rata refund for the cost of the
remainder of your Workshop. Please note we do not provide any repatriation
services back to the UK.
- Welshot Imaging Ltd reminds clients that by signing the booking form,
they are agreeing to accept all relevant terms and conditions. The person
who signs the booking form does so on behalf of all the individuals included
on it, so that all are bound by the booking conditions.
